These Terms and Conditions (“Terms” or “T&Cs”) govern the design, sale, supply and installation of pergolas, outdoor kitchens, outdoor furniture and related products and services provided by Lusso Verde Ltd (“Lusso Verde”, “we”, “us” or “our”) to the customer (“Customer”, “you” or “your”).

By placing an order with Lusso Verde, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

2. Scope of These Terms

These Terms and Conditions apply to:

• The design, supply and installation of pergolas, outdoor kitchens, outdoor furniture and related products and services;
  
• Orders placed through our website, by telephone, email or in person; and
  
• Any additional services or products supplied by Lusso Verde.
  

Where any specific terms have been separately agreed with you in writing, those terms will take precedence over these Terms and Conditions where there is any conflict.

3. Quotations & Orders

All quotations are valid for 30 days from the date of issue unless otherwise stated in writing. An order will only be accepted once it has been confirmed by Lusso Verde in writing, whether by email, signed quotation, order confirmation or other written agreement.

As many of our products are bespoke and manufactured specifically for each project, it is important that all measurements, specifications and site information provided are accurate. Any changes, inaccuracies or additional requirements identified after an order has been confirmed may result in additional costs or changes to the agreed installation schedule.

4. Pricing & Payment

Unless otherwise stated, all prices are quoted in GBP and are exclusive of VAT.

Our standard payment terms are as follows:

• 50% deposit payable upon order confirmation;
  
• 40% payment payable upon dispatch of the products;
  
• The remaining 10% balance payable upon completion of installation.
  

Alternative payment arrangements may occasionally be agreed in writing. Payments may be made by bank transfer or another payment method agreed with Lusso Verde in writing. We reserve the right to charge interest on overdue payments in accordance with applicable law.

5. Delivery & Installation

Any delivery or installation dates provided are estimates and are intended as a guide only. Although we will make every reasonable effort to meet agreed timescales, dates may occasionally change due to manufacturing schedules, weather conditions, site requirements, access issues or circumstances outside our reasonable control. Should there be a significant change to the proposed schedule, we will provide reasonable notice wherever possible. The Customer must ensure that suitable access and appropriate site conditions are available on the agreed installation date. Where installation is delayed or additional work is required due to inadequate access, incomplete preparation or unsuitable site conditions, additional charges may apply.

Risk in the goods will pass to the Customer upon installation or, where the Customer collects the goods, at the point of collection.

6. Customer Responsibilities

The Customer is responsible for ensuring that:

• The installation area is accessible, safe and suitably prepared;
  
• We are informed of any relevant underground services, structural issues, access restrictions or other site conditions;
  
• Any necessary permissions, consents or approvals have been obtained, including planning permission where required;
  
• Any requirements imposed by a local authority, property management company, homeowner association or other relevant body are complied with.
  

Lusso Verde cannot accept responsibility for delays, additional costs or damage resulting from the Customer's failure to meet these responsibilities.

7. Cancellation & Returns

Many Lusso Verde products are made to order and bespoke to the individual project. Once production of a bespoke pergola or custom-made product has commenced, the order may not be cancelled, except where required by applicable law. For non-bespoke or standard products, cancellation rights may apply in accordance with applicable consumer legislation. Where cancellation is permitted, the Customer may remain responsible for reasonable costs already incurred in connection with the order. Any goods believed to be faulty or damaged should be reported to us as soon as reasonably possible. Where applicable, remedies will be provided in accordance with the Consumer Rights Act 2015 and other relevant consumer legislation.

8. Warranties & Liability

We aim to ensure that all products and services supplied by Lusso Verde are of a high standard and provided with reasonable care and skill. Nothing in these Terms and Conditions excludes or limits any statutory rights available to you under UK consumer law. To the extent permitted by law, Lusso Verde will not be liable for any indirect, consequential or unforeseen loss arising in connection with an order. Subject to any rights that cannot legally be excluded or limited, our total liability in connection with an order shall not exceed the total amount paid by the Customer for that specific order.

9. Events Beyond Our Control

Lusso Verde will not be responsible for any delay or failure to perform its obligations where this is caused by circumstances beyond our reasonable control.

This may include, but is not limited to:

• Extreme weather conditions;
  
• Natural disasters;
  
• Pandemics or public health emergencies;
  
• Strikes or labour disputes;
  
• Transport or supply chain disruptions;
  
• Manufacturing delays;
  
• Government restrictions or other unforeseen events.
  

Where possible, we will keep you informed and work to minimise any resulting delay.

10. Intellectual Property

All intellectual property rights relating to Lusso Verde, including our designs, drawings, 3D visualisations, renders, animations, product concepts, marketing materials, photography and website content, remain the property of Lusso Verde Ltd or the relevant rights holder. These materials may not be copied, reproduced, distributed or used for any purpose without our prior written consent.

11. Complaints & Dispute Resolution

If you are unhappy with any aspect of our products or services, please contact us so that we have the opportunity to investigate and resolve the matter. We will always aim to resolve complaints fairly and amicably. If a matter cannot be resolved directly, you may have access to alternative dispute resolution services or other legal remedies available under applicable law.

12. Data Protection

Any personal information provided to Lusso Verde will be handled in accordance with our Privacy Policy and applicable UK data protection legislation.

13. Governing Law & Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales. Any dispute arising in connection with these Terms or an order will be subject to the jurisdiction of the courts of England and Wales, unless applicable law provides otherwise.

14. Changes to These Terms

Lusso Verde may update or amend these Terms and Conditions from time to time. The latest version will be published on our website and will include the relevant “Last Updated” date. Any changes will apply to future orders unless otherwise required by law.
